1. About DalyPaw

DalyPaw is a pet care communication app that connects pet owners with their caregivers. Pet caregivers log real-time activity updates — walks, feedings, potty breaks, playtime, notes, and photos — during a visit. Pet owners receive these updates instantly through the app and get a daily report card summarising their pet's day.

DalyPaw is a communication tool only. It does not employ, vet, supervise, or endorse any pet caregiver. Pet owners are solely responsible for selecting and trusting the caregivers they connect with on the platform.

2. Eligibility

You must be at least 18 years old to create a DalyPaw account. By using DalyPaw, you represent that you meet this requirement. DalyPaw is intended for use within Canada and the United States. Use from other jurisdictions is at your own risk and subject to applicable local laws.

3. Account Types

Pet Owners create a free account and are responsible for: the accuracy of their pet profiles; keeping their login credentials secure; and any activity that occurs under their account. Owners can remove caregiver access at any time from the Manage screen.

Pet Caregivers create an account to log care activities for the pets they look after. Caregivers agree to: log only accurate and truthful activity information; use the platform only for pets they are actively and legitimately caring for; not share their login credentials; and not create accounts on behalf of others.

Agency Admins manage a team of caregivers and a list of connected pet owner accounts. Agencies are responsible for ensuring their caregivers use the platform appropriately and that pet owners have consented to being added.

You are responsible for maintaining the confidentiality of your password. DalyPaw is not liable for any loss resulting from unauthorized use of your account.

4. How Connections Work

Caregivers add pet owners by email. If the owner already has a DalyPaw account, the connection is made immediately. If not, the connection is established automatically when the owner signs up. Owners can disconnect from a caregiver at any time. Caregivers can remove a pet owner from their account at any time.

5. Shareable Report Cards

DalyPaw allows caregivers to generate a shareable link to a daily report card summarising that day's pet care activities. By generating and sharing a report card link, you agree that:

• Anyone with the link can view the report card. Shared report cards are not password protected and may include pet names, activity logs, and photos from the visit.
• Shared links expire automatically after 7 days.
• You are solely responsible for deciding who to share the link with. DalyPaw is not responsible for unintended disclosure resulting from link sharing.
• You will not share report card links publicly or in any context where unintended viewers may access pet owner information.

6. Acceptable Use

You agree not to use DalyPaw to:

• Submit false, misleading, or fabricated activity logs
• Upload photos or content that is inappropriate, offensive, or harmful
• Access pet or owner information you are not authorized to view
• Impersonate another person or create fake accounts
• Attempt to reverse-engineer, scrape, or exploit any part of the platform
• Use DalyPaw in violation of any applicable law or regulation
• Harass, intimidate, or harm other users
• Share report card links publicly or in any way that could expose pet owner information to unintended recipients

DalyPaw reserves the right to suspend or permanently terminate any account that violates these Terms, without prior notice and without refund.

7. Content You Submit

You retain ownership of any content you submit to DalyPaw, including activity logs and photos. By submitting content, you grant DalyPaw a limited, non-exclusive license to store and display that content solely for the purpose of operating the platform.

You represent that any content you submit: (a) you have the right to share; (b) does not violate anyone's privacy, intellectual property, or other rights; and (c) is appropriate for a professional pet care context. DalyPaw does not use your content for advertising or AI training.

8. Privacy

Your use of DalyPaw is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using DalyPaw, you consent to the collection and use of your information as described in the Privacy Policy.

9. Subscriptions and Payments

Pet owner accounts are free. Pet caregiver accounts require a paid subscription after any applicable trial period. Subscription billing is handled through the Apple App Store. All payments, refunds, and billing disputes are subject to Apple's App Store terms.

Agency caregiver accounts are granted access by their agency and do not require a personal subscription.

10. Disclaimer of Warranties

DalyPaw is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or secure. Your use of DalyPaw is at your sole risk.

DalyPaw makes no guarantees about the quality, accuracy, or reliability of any activity log or photo submitted by a caregiver. Pet owners rely on caregiver-submitted content at their own discretion.

11. Limitation of Liability

To the maximum extent permitted by applicable law, DalyPaw, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, harm to a pet, or any damages arising from reliance on activity logs or communications made through the platform.

In no event shall DalyPaw's total liability to you exceed the amount you paid to DalyPaw in the 12 months preceding the claim, or CAD $100, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless DalyPaw and its team from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of DalyPaw; (b) your violation of these Terms; (c) your submission of false or harmful content; (d) any third-party claim relating to your use of the platform; or (e) any unintended disclosure resulting from your sharing of report card links.

13. Third-Party Services

DalyPaw uses third-party infrastructure including Supabase (database and authentication) and Vercel (hosting). Your use of DalyPaw is subject to their respective terms. DalyPaw is not responsible for the practices of any third-party service providers.

DalyPaw is distributed via the Apple App Store. Apple Inc. is not a party to these Terms and bears no responsibility for the app or its content.

14. Platform Availability

DalyPaw strives to maintain reliable uptime but does not guarantee uninterrupted availability. We may modify, suspend, or discontinue the platform at any time with or without notice. We are not liable for damages resulting from service interruptions.

15. Termination

You may stop using DalyPaw at any time by deleting your account. DalyPaw may terminate or suspend your account at any time if you violate these Terms or for any other reason at our discretion. Upon termination, access is revoked, all shareable report card links are deactivated, and your data is handled per our Privacy Policy.

16. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify active users of material changes via email or in-app notification. Continued use of DalyPaw after changes are posted constitutes your acceptance of the updated Terms.

17. Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes arising from these Terms or your use of DalyPaw shall be resolved exclusively in the courts of Ontario.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
